Is this legal under RBI and FEMA rules?
Yes. An Indian resident can own a foreign company. Depending on how you fund it, Overseas Direct Investment reporting through your bank may apply. Your dashboard includes a plain-language guide, and we can connect you with a CA who handles this every week.
Will Mercury actually approve me from India?
Most of our founders are approved. Approval depends on a real business description, a working website and a clear source of funds. Our banking guide shows exactly what to write and what gets people rejected.
Do I pay tax in the US and in India?
A single-member LLC owned from India usually pays no US income tax on services performed in India, but must file Form 5472 and a pro-forma 1120 every year. Skipping it is a $25,000 penalty. India taxes you on worldwide income, and the DTAA prevents double taxation. We remind you before every deadline.
What about GST on my US LLC income?
Services exported from India are zero-rated under GST with a Letter of Undertaking. Your CA handles this on the Indian side; we give you the documents they will ask for.
Is it legal to form a US LLC from outside the US?
Yes. You do not need to be a US citizen or resident to own a US LLC, and you never need to visit the US.
Will my name appear on public records?
Your name does not appear on the public Wyoming formation filing. USBizGuru signs the Articles as organizer and the registered agent address is listed, not yours. Wyoming does not list members or managers. Your name is on the private Operating Agreement and organizer statement that prove you own the company.
Does the $99 cover everything?
The $99 is our service fee for the Private US LLC package; Starter is $49. The Wyoming state filing fee of $103.75 is shown separately in every total and paid to the state. There are no other charges.
